Privacy Policy

 1. INTRODUCTION

We, KAVENTURE (hereinafter referred to as “MyDriverParis”) take the protection of your private data seriously and protect your private sphere when such data is processed, in compliance with the applicable laws on data protection.

These provisions on data protection give detailed information to you, as the user, about the type, extent and purposes of the collection, application and use of personal data by MyDriverParis, the provider responsible for these services. This data privacy statement applies in the same way to the services offered through the online platform, as to any functions in third party online platforms and applications for mobile end devices (“MyDriverParis Services”).

 2. DATA PROCESSING AND DATA TRANSFER

2.1 PROCESSING BY MYDRIVERPARIS

MyDriverParis Services will process the user’s personal data only to the extent necessary to justify and execute the MyDriverParis Services, for the content-related design or modification of the agreements on the use thereof, or for single business transactions. Data will furthermore only be processed if the user has given his/her consent herein.

In order to constantly improve and develop the MyDriverParis Services, MyDriverParis will make use of analysis tools to obtain information such as usage behaviour in the use of the MyDriverParis Apps and the website, for how long, the origin of the user with regard to the channel, the name of the website accessed, files downloaded, date and time of access and the type of browser used etc. We will also use any data connected with the use of our services to create advertisements for our services that are optimised for the interests of the user.

Subject to § 7 para 3 UWG we have the right to use your e-mail address which you have provided to us in the course of a booking for direct marketing purposes with respect to similar products or services of MyDriverParis. Should you not wish to receive advertisements for similar products or services, you can object to the usage of your e-mail address at any time without incurring any costs beyond the basic costs of transmission. You may unsubscribe from our product recommendation by clicking on the respective link provided in each e-mail.

2.2 TRANSFER

MyDriverParis will only transfer data to third parties for the purposes of fulfilling the contract or with the user’s consent. In particular this includes MyDriverParis transferring the user’s personal data to the required extent to transport service providers who have to carry the user.

Partner companies that are responsible for the technical processing of certain parts of the services offered by MyDriverParis (such as payment processing, dispatch of the driver’s contact information etc.) will also obtain certain data to process in a so-called data processing procedure. In such cases, the amount of data transmitted will, however, be limited to the required minimum.

Personal data will only be transferred to government offices and authorities in accordance with mandatory statutory provisions.

 3. DATA SECURITY

3.1 PRINCIPLES

MyDriverParis will always strive to process personal data taking all appropriate technical and organisational measures in order to ensure that they are secure and, in particular, that they are not accessible to unauthorised persons. In this respect, MyDriverParis expressly points out that communication by email cannot guarantee total data security. MyDriverParis thus advises any confidential information to be sent by post.

3.2 MEASURES

In order to protect the user’s data against accidental or intentional manipulation, loss, destruction or access by unauthorised persons in the best way possible, MyDriverParis will take appropriate technical and organisational security measures that can be optimised constantly in accordance with technical development.

 4. ANALYSIS TOOLS

4.1 GENERAL

The use of MyDriverParis will leave user-related information on the user’s computer in so-called “cookies”, that allow the MyDriverParis Services to be operated smoothly with extreme ease for the user. It is nonetheless possible for the cookies to be deleted after each use. In order to do this, the user should consult the documentation provided in the respective access programme (“browser”).

When MyDriverParis is used, data relating to the use is also saved automatically; this includes any websites visited, the length of each visit, the origin of the user with regard to the channel, the name of the website visited, the file, date and time of access, the quantity of data transmitted, report of successful access, browser type together with the version, the user’s operating system, the referrer URL (the previously visited site which referred to the website of MyDriverParis), the IP address and the requesting provider. This data is used, to the extent legally permissible, in order to analyse, save and evaluate user behaviour, and to constantly improve and develop the service.

In doing this, in addition to cookies we also use so-called tracking pixels that record, for example, the pages visited (on MyDriverParis’s own site but also those of third parties or newsletters).

MyDriverParis will also collect this data using the technologies of third party service providers. In particular, in order to analyse the usage behaviour on the MyDriverParis site, we avail ourselves of the various functions offered by search engine providers, advertising networks and distribution partners around the world who connect to third party sites by clicking on advertisements. These technologies make it possible to measure the success of an advertising placement, also because we can use this to make the subsequent usage behaviour visible on our own websites. Below is a detailed description of some of these analysis tools:

4.2 GOOGLE ANALYSIS TOOL

MyDriverParis uses Google Analytics, Google AdWords/Google Conversion Tracking and Google Remarketing Technology as well as the Google Tag Manager: all web analysis services of Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter referred to as “Google”).

These analysis services transmit IP addresses and use cookies that make it possible to analyse your usage of our websites and online services. The cookies have a limited validity (e.g. 30 days in the case of Google Conversion Tracking); the information generated by the cookie on your usage of these websites and online services is transmitted to a server of Google in the USA and stored.

The user can prevent cookies from being set up by adjusting the settings in his/her browser software. If the user decides to do this, he/she will not be able to use all functions of MyDriverParis Services. The processing of data with regard to Google Analytics can be stopped at any time with immediate effect, by installing an appropriate browser plug-in of Google.

4.2.1 GOOGLE ANALYTICS

As an AdWords customer, MyDriverParis will use Google Conversion Tracking, which is also an analysis service of Google Inc. In this process, Google AdWords sets a cookie on the user’s computer (“conversion cookie”), providing the user has reached the Mobile Services through a Google advertisement. This cookie becomes invalid after 30 days and is of no use with regard to the personal identification of the user. If the user visits certain sites within the Mobile Services and the cookie has not yet expired, MyDriverParis and Google will be able to detect that someone has clicked on the advertisement and has thus been redirected to the relative site. Each AdWords customer will receive a different cookie. It is thus not possible to keep track of cookies via the websites of AdWords customers. The information obtained with the help of the conversion cookies serves to create conversion statistics for AdWords customers, who have opted for conversion-tracking. AdWords customers learn the total number of users who have clicked on their advertisement and have been redirected to a site with a conversion-tracking-tag. However, they do not receive any information with which the user can be personally identified. If you do not wish to participate in the tracking procedure, you can also refuse the setting of cookies necessary for this purpose – for example by means of the browser setting that automatically disables the general setting of cookies. You can also disable cookies for conversion-tracking by setting your browser in such a way that cookies are blocked by the domain “googleadservices.com”.

4.2.2 GOOGLE ADWORDS/GOOGLE CONVERSION TRACKING

MyDriverParis also uses the Remarketing Technology, also of Google Inc. This technology re-approaches users who have already visited Mobile Services and shown interest in the offer, by means of targeting advertisements on the sites of the Google Partner Network. The fading in of advertisements is also done by the use of cookies. With the aid of this cookie, it is possible to analyse a user’s behaviour when visiting the website and, and then use this for targeted product recommendations and interest-based advertisements. If the user would not like to receive any interest-based advertisements, he/she can disable the use of cookies by Google for these purposes, namely by calling up the site www.google.de/settings/ads and following the steps given to disable.

4.2.3 GOOGLE REMARKETING TECHNOLOGY

MyDriverParis also uses Google Tag Manager, also a Google product, that makes it possible to manage website tags through a single interface. The Tag Manager is a cookie-free domain and does not record any personal data. The tool allows other tags to be triggered off that can, in turn, record data. Google Tag Manager does not access this data. If domains or cookies have been disabled, this situation will remain for all tracking tags that are implemented with Google Tag Manager.

4.2.4 GOOGLE TAG MANAGER

MyDriverParis uses Google Analytics with the extension “_anonymizeIp()”, which means that any IP addresses that are transmitted to Google Analytics are first shortened and further processed on servers located in Europe, in order to exclude any direct reference to the user. Google will use this information in order to evaluate the visit to the website, to compile reports on the website activities for MyDriverParis and to provide further services connected with use of the website and internet. Google will furthermore transmit this information to third parties, if necessary, to the extent legally prescribed or if third parties process this data on Google’s behalf. Google will not, under any circumstances, connect the user’s IP address with other data of Google.

4.3 INTEGRATION OF THIRD PARTY SERVICES AND CONTENTS

It may occur that within this online offer, the contents of third parties, such as New Relic, an analysis service of New Relic Inc., 101 Second Street, 15th Floor, San Francisco, CA 94105 (“New Relic”) or eKomi Ltd., Markgrafenstraße 11, 10969 Berlin (“eKomi”), are integrated in order to obtain customer appraisals. This always requires the provider of these contents (hereinafter referred to as “Third-party providers”) to observe the IP address of the user. Without the IP address in fact, they would not be able to send the contents to the browser of the respective user. The IP address is thus necessary in order to represent these contents. We strive to use only the contents of providers who use the IP address for the mere purpose of delivering the contents. However, we do not have any influence on whether or not the third party providers use the IP address for statistical purposes, for example. If we are aware of this, we will inform the user accordingly.

MyDriverParis also uses the Remarketing Technology service of Facebook (Facebook, Inc., 1601 Willow Road, Menlo Park, CA 94025). This basically works in the same way as described above for the Technology of Google. You can find further information under https://www.facebook.com/about/privacy/. MyDriverParis also uses a conversion-tracking tool and the following use analysis, as described above, and other search engine providers such as Microsoft (Bing), Yandex (Russia), Baidu (China) and Yahoo (e.g. for Japan), as well as other distribution partners including Twitter, and third parties.

 5. GOOGLE RECAPTCHA

MyDriverParis uses the reCAPTCHA service provided by Google Inc. (Google) to protect your submissions via internet submission forms on this site. This plugin checks if you are a person in order to prevent certain website functions from being (ab)used by spam bots. This plugin query includes the sending of the IP address and possibly other data required by Google for the Google reCAPTCHA service. For this purpose your input will be communicated to and used by Google. However, your IP address is previously truncated by Google within member states of the European Union or in other states which are party to the agreement on the European Economic Area and is, as such, anonymized. Only in exceptional cases is a full IP address transmitted to a Google server in the United States and truncated there. On behalf of MyDriverParis, Google will use this information to evaluate your use of this service. The IP address provided by reCAPTCHA from your browser shall not be merged with any other data from Google.

By using the reCAPTCHA service, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

 6. SOCIAL MEDIA FUNCTIONS

MyDriverParis uses the social media functions of Twitter, Google (Google+) and Facebook (especially Facebook Messenger).

The Twitter functions are provided by Twitter Inc., 1355 Market Street, Suite 900, San Francisco, CA 94103, USA. By using Twitter and the functions integrated on our sites, information such as: the websites visited connected with the Twitter account and disclosed to other users [sic]. In this process data is transmitted to Twitter. MyDriverParis does not receive any information about the contents of the data transmitted or their usage by Twitter. Further information can be seen from the data privacy statement of Twitter under http://twitter.com/privacy, as well as information on the changes to the account settings.

Google+ is provided by Google Inc. (see also point 4.2 above). If further websites are called up using the Google+ tool, data is sent directly to Google. Further information on the processing and use of the data by Google, as well as any setting options, can be taken from Google’s data protection advice, which can also be found under: https://www.google.com/policies/privacy/partners/.

If you do not wish data to be collected on our websites through Google+ or Twitter, please log out of the relative user account of the respective service before calling up our websites.

You may use Facebook Messenger to communicate with us. Messenger is a product of Facebook Inc. When using Messenger, data will be transferred to Facebook. Facebook might potentially use the data also for its own purpose, further details on which may be found in its privacy policy (see 4.3 above).

 7. CREDIT CARD DETAILS

All bookings at MyDriverParis can be paid by credit card. Credit card details have to be saved only when booking for the first time and are protected against unauthorised access. MyDriverParis does not store this information. A certified payment provider is used for this purpose, whose systems meet the applicable security standards such as the PCI-DSS standard (Payment Card Industry Data Security Standard). In the case of recurring transactions, the credit card data is stored with the PCI-DSS certified payment provider engaged.

 8. CONTACT, DELETION, INFORMATION AND REPORTING/CONSENT GIVEN

On application, the user will receive information about the data he/she has saved, free of charge. The user also has the right to delete his/her personal data or, if this is incorrect, to have it corrected. Personal data that must be stored due to mandatory legal provisions will be blocked.

Any consent given can be revoked at any time with immediate effect. In the case of newsletters sent by email, this is also possible by clicking on the relative unsubscribe link provided in the email.
